Terms of Service

These terms govern your use of GrowOS and of any Sindal customer account used to subscribe to it. GrowOS is provided by Sindal Technology International Limited, a company registered in Hong Kong (“Sindal”, “we”, “us”). By creating an account or using the service you agree to these terms.

1. Who may use the service

GrowOS is offered to businesses, not to consumers. You must be at least 18 years old and authorised to act for the business you register. You are responsible for the accuracy of the business information you provide and for keeping it current.

2. Accounts

You are responsible for your account credentials and for everything done through your account. If you invite colleagues into your organisation, you are responsible for the roles you grant them and for removing access when it is no longer appropriate. Tell us promptly if you believe your account has been compromised.

3. What the service does

GrowOS produces marketing content from the materials and directions you supply, and — where you have connected them — publishes that content to your own Facebook Page and Instagram account and handles comments and direct messages received there on your behalf. Content is generated with the assistance of artificial intelligence. You remain responsible for reviewing what is published under your business's name.

4. Connected social media accounts

Connecting a Facebook Page or Instagram account is optional and is done through Meta's own authorisation flow. By connecting an account you confirm that you are entitled to authorise access to it, and you instruct us to act on it as described in the service. Your use of Facebook and Instagram remains subject to Meta's own terms and policies, and you must not use GrowOS in a way that would breach them. You may withdraw our access at any time; doing so will stop the parts of the service that depend on it. We are not responsible for changes Meta makes to its platforms, permissions or policies.

5. Your content

The materials you upload and the content produced for you remain yours. You grant us the licence necessary to host, process, transmit and publish that material for the purpose of providing the service to you — including sending it to the AI and infrastructure providers we use, and to Meta when publishing on your instruction. You confirm that you hold the rights needed for the materials you supply, including any necessary consent from people appearing in photographs or video.

6. Acceptable use

You must not use GrowOS to produce or publish content that is unlawful, deceptive, infringing, defamatory, or that breaches the platform rules of any connected service. You must not use it to send unsolicited bulk messages, to impersonate another business or person, or to attempt to gain unauthorised access to our systems or another customer's data. We may suspend an account that is being used in these ways.

7. Subscriptions, trials and payment

Paid plans are described on the plan page shown in your account at the time of purchase. Where a free trial is offered, the trial length and what happens at the end of it are stated before you start it. Payment is taken by a third-party payment provider; we do not receive or store your card details.

Subscriptions renew automatically for successive billing periods until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current paid period, and the service continues until then. Fees already paid are not refunded except where required by law or where we agree otherwise in writing. If a payment fails we may suspend or downgrade the service after notifying you. We may change prices, and will give at least 30 days' notice before a change applies to your renewal.

8. Availability

We aim to keep the service available and to give advance notice of planned maintenance, but we do not guarantee uninterrupted availability. Parts of the service depend on third parties — Meta and our AI providers among them — and may be affected by their outages or by changes they make.

9. Intellectual property

The GrowOS platform, its software and its branding remain the property of Sindal. These terms do not transfer any of that to you. You may not copy, reverse engineer or resell the platform.

10. Disclaimers and liability

The service is provided on an “as is” basis. We do not warrant that AI-generated content will be accurate, suitable for a particular purpose, or that it will achieve any particular marketing result. To the fullest extent permitted by law, our total liability arising out of or in connection with the service in any 12-month period is limited to the fees you paid us for the service in that period, and we are not liable for indirect or consequential loss, loss of profit, or loss of goodwill. Nothing in these terms limits liability that cannot be limited by law.

11. Suspension and termination

You may close your account at any time. We may suspend or terminate an account that breaches these terms, that is used unlawfully, or where required by law, and we will give notice where it is reasonable to do so. On termination we handle your data as described in the Privacy Policy.

12. Changes to these terms

We may update these terms. Where a change materially affects your rights we will notify account holders before it takes effect. Continuing to use the service after that date means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over any dispute arising from them.
